These Terms of Service ("Terms") govern your use of all products and services provided by Postic.ai ("Postic", "we", "us", or "our"), including our Shopify app, mobile applications, TikTok integrations, website (postic.ai), and any other platforms or services we operate (collectively, the "Services"). By using the Services, you agree to these Terms.

1. Eligibility

• You must be at least 13 years old (or the applicable minimum age in your jurisdiction) to use the Services
• If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms
• You are responsible for ensuring your use of the Services complies with all applicable laws in your jurisdiction

2. Description of Services

Postic provides AI-powered tools for social media content creation and management, including but not limited to:

• AI image editing and video generation
• Social media post scheduling and automation
• Content publishing to Instagram, Facebook, TikTok, LinkedIn, and other platforms
• Analytics and engagement tracking
• Shoppable feed widgets for e-commerce stores

Features may vary across platforms (Shopify app, mobile app, web) and subscription plans.

3. Accounts & Access

• You are responsible for maintaining the security of your account and connected social media accounts
• You must not share your account credentials with others
• You must comply with each connected platform's terms of service (Shopify, Instagram, Facebook, TikTok, LinkedIn, etc.)
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Credits & Billing

• Postic uses a credit-based system — certain actions (posting, AI editing, video generation) consume credits from your balance
• Paid plans are billed through the applicable platform's billing system (e.g., Shopify billing, App Store, Google Play) or directly through our payment processors
• Unused credits do not roll over to the next billing period unless explicitly stated
• Refunds are handled per the applicable platform's refund policies
• We reserve the right to modify pricing and credit costs with reasonable notice

5. Content Responsibility

• You are solely responsible for all content created, edited, and published through Postic
• AI-generated content (captions, hashtags, images, videos) are suggestions and tools — you must review content before publishing
• You must not use the Services to create or distribute content that is illegal, harmful, defamatory, or violates third-party rights
• We are not liable for content that violates platform guidelines or results in account restrictions on social media platforms
• You retain ownership of your original content. By using the Services, you grant us a limited license to process your content as needed to provide the Services

6. AI-Generated Content

• AI features (image editing, video generation, caption writing) use third-party AI models
• AI outputs may not always be accurate, appropriate, or free of errors
• You are responsible for reviewing and approving all AI-generated content before use
• We do not guarantee that AI-generated content will be unique or free from similarity to existing works

7. Prohibited Uses

You must not:

• Use the Services for any illegal purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Services
• Use automated means to access the Services beyond the intended functionality
• Circumvent usage limits, credits, or security measures
• Resell or redistribute the Services without authorization
• Use the Services to spam, harass, or engage in deceptive practices

8. Service Availability

• We strive for high availability but do not guarantee uninterrupted service
• Scheduled posts may be delayed due to platform API limitations, rate limits, or maintenance
• Third-party platform outages (Instagram, TikTok, etc.) are outside our control
• We may modify, suspend, or discontinue features with reasonable notice

9. Intellectual Property

• Postic and its original content, features, and functionality are owned by us and protected by intellectual property laws
• The Postic name, logo, and branding are our trademarks
• You may not use our branding without written permission

10. Limitation of Liability

To the maximum extent permitted by law:

• The Services are provided "as is" and "as available" without warranties of any kind
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for losses resulting from social media platform policy changes, API changes, or account restrictions

11. Indemnification

You agree to indemnify and hold Postic harmless from any claims, damages, or expenses arising from your use of the Services, your content, or your violation of these Terms.

12. Termination

• You may stop using the Services at any time by uninstalling the app or deleting your account
• We may suspend or terminate your access for violation of these Terms
• Upon termination, your right to use the Services ceases immediately
• Data deletion follows the timeline described in our Privacy Policy

13. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation first, then through binding arbitration or the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms at any time. We will notify you of significant changes through the Services or by email. Continued use of the Services after changes constitutes acceptance of the updated Terms.
